How to Check Financial Liabilities Before Marriage in India

Money conversations can feel awkward before marriage, but they can prevent avoidable surprises later. The aim is not to demand a person's entire financial history. It is to understand obligations and habits that could materially affect shared plans, with the same transparency expected from both partners.

What should couples discuss?

Consider outstanding loans and EMIs; credit-card balances; education or business debt; guarantees or co-borrower obligations; financial support for dependants; recurring commitments; savings goals; insurance and emergency planning; and expectations about joint versus separate accounts. Not every couple needs the same level of detail, so agree on what is relevant.

Separate disclosure from verification

A conversation is a disclosure; a document is supporting evidence; an authorised check may provide another level of confirmation. These are different. Ask the person to explain any document they voluntarily share, and clarify whether figures represent current balances, original loan amounts, monthly payments or estimates. Keep records dated because balances change.

Credit reports and privacy

Credit reports and financial account information are sensitive. Do not attempt to access another person's credit report, bank account or financial profile without the required consent and authority. If both people want to review credit information, they should obtain their own reports through authorised channels and share only what they are comfortable disclosing. Refusal to discuss any material obligation may be worth revisiting, but it is not proof of fraud. Likewise, having debt is not automatically irresponsible; the amount, terms, repayment plan and shared expectations matter. If a material claim appears inconsistent, ask for clarification and consider independent professional advice.

Protect the information

Limit document collection to what is needed, mask account numbers where possible, store files securely, restrict access and agree how long copies will be retained. Do not forward financial documents to family groups or publish them. Consider a qualified financial adviser or lawyer if the planned arrangement involves shared assets, guarantees or significant obligations.

What the law says

The provisions below are summarised from the official text on India Code. Laws and their commencement change, so check the current text or ask a lawyer before you rely on them.

  • Section 6 of the Digital Personal Data Protection Act, 2023 says consent must be free, specific, informed, unconditional and unambiguous, and limited to the personal data needed for the stated purpose.
  • Section 3 of the DPDP Act says it does not apply to personal data processed by an individual for a personal or domestic purpose. A family's own enquiries may fall outside it, but a verification service that handles the data is covered.
  • Section 8 of the DPDP Act requires an organisation to keep personal data complete, accurate and consistent when it is used to make a decision about that person, and to protect it with reasonable security safeguards.
